Terms and conditions for the right of use to a .dk domain name

These terms constitute Version 15, effective as of 1 July 2026, laid down pursuant to Section 14(1) of the Danish Domain Names Act (Domæneloven). Punktum dk A/S is obliged to observe good domain name practice when laying down these terms, cf. Section 14(3) of the Danish Domain Names Act.

About the right of use to a .dk Domain Name

1.1 These terms and conditions for the right of use of a .dk domain name (hereinafter referred to as ‘the Terms and Conditions’) set out the conditions, including the rights and obligations, that apply to the right of use of a second-level domain name under the .dk domain (hereinafter ‘the Domain Name’).

1.2 These Terms and Conditions are set by Punktum dk A/S (hereinafter referred to as ‘Punktum dk’) and are accepted in connection with the conclusion or renewal of an agreement with Punktum dk regarding the right of use of a Domain Name (hereinafter ‘the Agreement’).

1.3 An ‘Applicant’ is a legal or natural person who submits an application for a Domain Name to a ‘Registrar’ of their own choosing. A Registrar may be established both within and outside the EU and sells Domain Names on the basis of a valid registrar contract with Punktum dk.

An Applicant may only be considered for the right of use of a Domain Name that has not already been registered or suspended.

1.4 Applicants who are granted the right of use of a Domain Name, and legal or natural persons to whom a Domain Name is transferred, become a ‘Registrant’ upon entering into an Agreement with Punktum dk. These Terms and Conditions form an integral part of the Agreement between the Registrant and Punktum dk.

1.5 The conclusion of an agreement on the right of use of a Domain Name, as well as its renewal, is not subject to the provisions of the Danish Consumer Contracts Act (Forbrugeraftaleloven) regarding the right of withdrawal, cf. the exemption set out in Section 18(2), No. 13, of the Danish Consumer Contracts Act.

1.6 Punktum dk may terminate the Agreement as described in these Terms and Conditions in the event that a Registrant fails to comply with their obligations. Registrants shall not be entitled to a refund of the payment for a Domain Name in such cases.

When an Agreement is terminated, regardless of the reason, this means that the Domain Name will be suspended for a period of 30 days, after which the Domain Name will be deleted. From the time of suspension, Punktum dk will cease to publish information about the Registrant and its possible proxy in Punktum dk’s publicly available WHOIS database.

The suspension of a Domain Name means that the Domain Name is disconnected from the name servers, so that, among other things, the website in its entirety and email addresses associated with the Domain Name will no longer function.

The deletion of a Domain Name means that the Domain Name becomes available for registration again.

2. Administration of Domain Name

2.1 As of 1 July 2026, Registrants can choose the following scheme for the management of their rights of use of a Domain Name.

By entering into an agreement with a Registrar, the Registrant grants the Registrar the authority to perform certain actions on the Registrant’s behalf (hereinafter referred to as ‘Registrar Management’), which collectively comprise the following:

  • Making payments to Punktum dk in connection with the conclusion of an Agreement and its renewal, and upon the reinstatement of a Domain Name that has been suspended, where this is permitted under the Terms and Conditions.
  • Updating the Registrant’s contact information: Email address(es), telephone number(s) and, where applicable, the contact person specified, as well as the postal address in the event the Registrant resides outside of Denmark or cannot be linked to the CPR or CVR Register.
  • Carrying out a verification of the Registrant’s identity and contact details, if the Registrar has opted to be responsible for this.
  • Managing name servers: Ensuring the connection of at least two authoritative name servers, changing name servers, managing security measures, including DNSSEC, creating name servers under the Domain Name, and, where applicable, offer name server services.
  • Completing the transfer of the Domain Name.
  • Terminating the Agreement on the right of use of the Domain Name.

2.2 For domain names that, at the time at which these Terms and Conditions enter into force on 1 July 2026, are registrant-managed, the Registrant may choose to continue performing certain actions themselves relating to the management of the right of use of the Domain Name or, by agreement, allow others to assist with this (hereinafter referred to as ‘Registrant Management’). This assistance may include the following:

  • The Registrant may appoint another legal or natural person to act as the billing contact for the Domain Name. This person will then handle all payments to Punktum dk on behalf of the Registrant.
  • The Registrant may agree with another legal or natural person that the person in question should be appointed proxy to act on behalf of the Registrant to a limited extend, which includes: Initiating changes of name servers, implementing security measures, including DNSSEC, registering name servers on the Domain Name, changing the registration period for a Domain Name, replacing the billing contact for the Registrant’s Domain Name etc.

2.3 The options for action associated with the roles of a billing contact and an appointed proxy, see Clause 2.2, are described in more detail on Punktum dk's website.

The Registrant is responsible vis-à-vis Punktum dk for ensuring that the contact details provided for persons who may perform the roles of a billing contact and an appointed proxy are accurate. For appointed proxies that are legal persons, at least one email address and one telephone number that does not contain personal data must be provided.

2.4 Under Registrar Management, a Registrant is entitled at any time to switch to Registrar Management with another Registrar.

If the Registrar with whom the Registrant has entered into an Agreement does not have a valid registrar contract with Punktum dk, Punktum dk will switch the Registrant to temporary Registrant Management.

2.5 Under Registrant Management, Registrants are permitted to switch a Domain Name to Registrar Management, provided that there are no unpaid invoices from Punktum dk relating to the Domain Name.
 

3. Application for the right of use to a Domain Name

3.1 Applications for the right of use of a Domain Name must be made through a Registrar.

3.2 The Applicant must enable the Registrar to submit the following information in an application to Punktum dk:

  • The requested Domain Name.
  • The names of at least two authoritative name servers registered with Punktum dk.
  • Accurate details of the Applicant – i.e. their full name, a physical postal address, telephone number(s) and e-mail address(es). For legal persons, at least one email address that does not contain personal data must be provided, unless the Applicant whose personal data is contained in the email address has given their consent for Punktum dk to publish the email address containing personal data.
  • The Applicant's CVR number, if the Applicant is a legal entity domiciled in Denmark.

If an application is made for a Domain Name that Punktum dk offers separately to an Applicant on the waiting list, the Applicant must submit an application for the Domain Name to a Registrar and ensure that the Registrar can forward an associated code issued by Punktum dk.

3.3 A Domain Name can only be requested for registration for a period of one (1) year at a time. This applies both when applying for a Domain Name and when renewing the registration period. The registration period can be renewed no earlier than two (2) months before the expiration of the existing registration period.

3.4 The registration period begins when Punktum dk registers the Domain Name after checking:

  • that the Domain Name is not already registered or suspended, and
  • the application contains the information specified in Clause 3.2.

The initial registration period runs from the day Punktum dk registers the Domain Name through until the end of that period.
 

4. Accurate contact information

4.1 Registrants must ensure that their identity and contact information in Punktum dk’s systems are accurate at all times. This means that the Registrant's identity and contact details must be correct and up to date, such that:

  • the Registrant is correctly registered with Punktum dk with accurate identity and contact information,
  • it is possible at all times to obtain information regarding who is behind a Domain Name as the Registrant, and
  • the Registrant can be contacted directly.

4.2 Under Registrant Management, the Registrant must ensure accurate identity and contact information in the manner prescribed by Punktum dk.

Under Registrar Management, a Registrant has granted a Registrar the authority to update email address(es), telephone number(s), and any specified contact person on their behalf, as well as a postal address in the event that the Registrant resides outside Denmark or cannot be linked to the CPR or CVR Register.

4.3 The Registrar may choose to perform data and ID control.

As part of controlling the Registrant’s identity and contact information, the Registrar may conduct an investigation of the information associated with the registration of the Domain Name. The Registrar specifies the control measures that the Registrant must follow.

The Registrar decides whether the Registrant has completed the data and ID control as instructed. If the Registrant does not complete the data and ID control as instructed, the Agreement may be terminated. Such a decision may apply to all Domain Names for which a Registrant with the given contact information holds a right of use.

4.4 Punktum dk may perform data and ID control.

As part of controlling the Registrant’s identity and contact information, Punktum dk may conduct an investigation of the information associated with the registration of the Domain Name.
In addition, as part of controlling the Registrant’s identity and contact information, Punktum dk may specify the control measures that the Registrant must follow. These may include:

  • electronic identification,
  • a request to submit documentation in Danish, English, or in other languages supported by Punktum dk, regarding the Registrant’s identity and contact information as they appear in Punktum dk’s systems,
  • making updates to contact information on the request of Punktum dk.

If a Registrant cannot ensure that their identity and contact information are accurate, or if a request from Punktum dk has not been answered within 25 days of being sent, Punktum dk may terminate the Agreement. Such a decision may apply to all Domain Names for which a Registrant with the given contact information holds a right of use.

The deadline for responding to a data and ID control may be shortened to 10 days if exceptional circumstances so require.

4.5 Messages from Punktum dk to a Registrant are sent electronically using the contact details provided by the Registrant. Punktum dk is entitled to terminate the Agreement even if the message is not received by the Registrant or if it, for any other reason, does not come to the Registrant’s attention.

4.6 Messages sent from Punktum dk to an appointed proxy in connection with a data and ID control of the proxy’s contact information shall be sent electronically using the contact details registered for the proxy. Punktum dk is entitled to remove the appointed proxy from the Domain Name if the proxy does not complete the data and ID control of their contact information as instructed by Punktum dk. This applies even if the message is not received by the appointed proxy or if it, for any other reason, does not come to the proxy’s attention. Such a decision may apply to all Domain Names for which an appointed proxy with the given contact information acts as representative.

5. Payment for a Domain Name

5.1 Registrants pay a fee to have the Domain Name registered for a period (hereinafter ‘the Period Fee’). If the Registrant is under Registrant Management, they are responsible for the ongoing payment of the Period Fee to Punktum dk. If the Registrant is under Registrar Management, the Registrar will make the payment to Punktum dk on behalf of the Registrant.

5.2 The right of use of a Domain Name may be renewed by paying the Period Fee for a new registration period. This renews the Agreement with Punktum dk for the right of use of the Domain Name.

5.3 Under Registrar Management, the Registrar is automatically responsible for ensuring that the payment for the Domain Name is made to Punktum dk, unless the Registrar has notified Punktum dk that the Agreement should not be renewed.

5.4 Under Registrant Management, after the first registration period, a Registrant or the person who has been appointed as the billing contact of the Registrant’s Domain Name may pay the Period Fee for the renewal of the Agreement directly to Punktum dk.

If the Registrant has appointed a person to the role of billing contact, Punktum dk shall issue invoices and send communications regarding payments to that person.

A Registrant or the person acting in the role of appointed proxy may not replace the person in the role of billing contact in the event that there is an unpaid invoice from Punktum dk relating to the Domain Name.

5.5 If a registration period is not renewed by payment of a new Period Fee, Punktum dk

will suspend the Domain Name for a period of 30 days.

5.6 Registrants are entitled, against the payment of a fee, to have a Domain Name reinstated if it has been suspended due to non-payment of the Period Fee.

Under Registrar Management, the Registrant has authorised a Registrar to have a Domain Name reinstated on their behalf if it has been suspended due to non-payment of the Period Fee.

Under Registrant Management, payment for the reinstatement of a suspended Domain Name may be made without revealing who is making the payment. In that case, however, renewal of the registration period is conditional upon the Registrant subsequently indicating, in the manner prescribed by Punktum dk, that they wish to renew the Agreement. It is also a condition that the Registrant ensures their contact information is accurate, cf. Section 4.

5.7 If the new Period Fee and the fee for reinstatement of the Domain Name are not paid during the suspension period, cf. Clause 5.5, Punktum dk will delete the Domain Name.

5.8 Punktum dk may unilaterally introduce or change fees, if necessary, in order to cover the costs of providing and operating services related to the administration of Domain Names. The introduction or amendment of fees may be justified by factors related to the maintenance and updating of user interfaces, IT systems, and administrative processes; product development; changes in legal requirements or standards; inflation and price index adjustments; expenses to suppliers or other external parties; or the need to address legal claims. Further details can be found on the Punktum dk website.

5.9 All fees are listed on the Punktum dk website. All payments and payment information to Punktum dk must be made in the manner prescribed by Punktum dk.

6. Requirement of connection to name servers

6.1 A Domain Name must be connected to at least two authoritative name servers, and these must be registered with Punktum dk by the legal or natural person who has control over the respective name servers.

If there are not at least two authoritative name servers connected to the Domain Name, Punktum dk may terminate the Agreement.

6.2 Under Registrar Management of a Domain Name, the following applies:

  • The Registrar must ensure compliance with Clause 6.1.
  • The Registrar must implement enhanced security measures for the Domain Name, including DNSSEC. The latter is ensured by the Registrar either offering the Registrant DNSSEC signing or informing the Registrant as to who can provide it.
  • The Registrar must change the name servers for the Domain Name where necessary.

6.3 Under Registrant Management, the following applies:

  • The person who has control over the name servers, cf. Clause 6.1, may implement enhanced security measures for the Domain Name, including DNSSEC. If a Registrar has such control, the Registrar must either offer DNSSEC signing or inform the Registrant as to who can provide it.
  • A Registrant may, to the extent permitted by technical industry standards, choose to implement the above-mentioned security measures themselves, and they may also opt out of such security measures. This must be done in the manner specified by Punktum dk.
  • A Registrant may initiate a change of name servers for the Domain Name.

6.4 A change of name servers must be carried out in the manner prescribed by Punktum dk and is subject to the Domain Name not being suspended by Punktum dk, and to the new name servers being registered with Punktum dk and being authoritative for the Domain Name.

7. Registrant’s Transfer of a Domain Name and termination of Agreement

7.1 Registrants are entitled to transfer Domain Names to another natural or legal person. The transfer must be carried out in the manner specified by Punktum dk. Under Registrant Management, it is a condition for the transfer that there are no unpaid invoices from Punktum dk relating to the Domain Name.

7.2 In the event of a transfer, the new Registrant succeeds to the prepaid registration period of the previous Registrant.
It is the condition of the transfer that the new Registrant enters into an agreement for the right of use of the Domain Name. Upon transfer, Punktum dk shall also control the new Registrant’s identity and contact information, cf. Section 4.

7.3 Registrants are entitled to terminate the Agreement at any time, whereby the Agreement will cease, and the Domain Name will be suspended on the date of termination or upon expiry of the prepaid registration period. Termination must be carried out in the manner specified by Punktum dk.

Under Registrar Management, the Registrant authorises the Registrar to terminate the Agreement on their behalf.

7.4 If a Registrant terminates the Agreement before the end of a registration period, Punktum dk will refund any surplus amount electronically to the Registrant. An amount corresponding to the Period Fee for the remaining part of the prepaid registration period, less a termination fee, will be refunded.

7.5 A terminated Domain Name will be suspended for 30 days and subsequently deleted, unless the Registrant, against the payment of a fee, has reacquired the right of use by reinstating the Domain Name before the end of the suspension period.

Under Registrar Management, the Registrant must authorise the Registrar to have a Domain Name reinstated and to make payment for this on the Registrant’s behalf.

7.6 Registrants may not transfer a Domain Name in the following cases:
 

  • When complaint proceedings concerning the relevant Domain Name have been initiated before the Danish Complaints Board for Domain Names (Klagenævnet for Domænenavne), and for as long as the case is under consideration by the Board.
  • When Punktum dk has received documentation stating that legal proceedings concerning the Domain Name have been initiated before a court, and for as long as it can be documented that the case is pending before the court.
  • When Punktum dk has become aware that the Registrant has been declared bankrupt or has passed away, and until the Domain Name has been taken into possession by the estate or the estate has been closed.
  • When Punktum dk, based on a complaint, has initiated a case concerning the unlawful use of a Domain Name, and for as long as the case is under consideration by Punktum dk.
  • If a control of the Registrant’s identity and contact information has been initiated, and for as long as this control is ongoing.
  • If an invoice has been issued but payment has not yet been received by Punktum dk.
  • If the Domain Name has been suspended, regardless of the reason.
     

8. Disclosure of information

8.1 Registrants have the right to receive or access information that Punktum dk holds concerning a Domain Name of which they are, or have been, the Registrant. However, Registrants may only obtain information relating to the period during which they have been the Registrant of the Domain Name.

8.2 Registrants have the right to receive or access information about the Registrar in relation to the Registrant and for the period during which they have been the Registrant of the Domain Name.

8.3 For the provision of information to a Registrant under Registrar Management, the Registrant is referred to their Registrar.

8.4 Punktum dk may disclose or provide access to a Registrant’s identity and contact information, as well as any other information related to the Domain Name, to the following:

  • A Registrar that manages the Domain Name on behalf of a Registrant as part of Registrar Management, or a Registrar that conducts data and ID control.
  • A Registrar or other third party who, by agreement with the Registrant, performs the role of billing contact or appointed proxy.
  • A name server manager who manages name servers on behalf of the Registrant.

Information about the Registrant and the Domain Name may only be disclosed to a Registrar or third party for the period during which they have had an agreement with the Registrant.

8.5 Punktum dk may, upon request, disclose or provide access to information about a Registrant or a Domain Name to persons other than the natural and legal persons mentioned in Clauses 8.1 and 8.4, who are entitled to such information under Danish law.

9. Unlawful use of a Domain Name

9.1 Punktum dk may suspend a Domain Name if:

  • there is an obvious risk that the spelling or typing errors of internet users when they type an URL in an address bar are used to create confusion with a different almost identical Domain Name and thereby generate traffic on their own website, and,
  • the Registrant of the Domain Name that is exploited in the case of confusion submits a notification, and,
  • the Domain Name that is exploited in the case of confusion and the notified Domain Name are active in relation to the public, for example for the operation of a website, and
  • the notified Domain Name is registered within the last 5 years, calculated from the date of notification and at a later time than the notifier has had its Domain Name registered to him, and
  • the Registrant of the notified Domain Name does not have relevant trademark rights or rights to names or other distinctive marks or any other technical reason to make use of the Domain Name, and
  • the Registrant of the notified Domain Name and/or a legal or natural person who is closely related to the Registrant has registered at least two other Domain Names with a corresponding obvious risk of confusion as mentioned above..

Punktum dk will not decide on suspension of the notified Domain Name until the Registrant of the Domain Name has had an opportunity to make a statement in the case.

The Registrant of the notified Domain Name gets a deadline of 72 hours to make a statement. The deadline is calculated from the time when Punktum dk sends the notification to the Registrant with a request for the Registrant to make a statement.

The suspension of the Domain Name is maintained for four weeks or, if the decision on suspension is appealed to the Danish Complaints Board for Domain Names (Klagenævnet for Domænenavne) until the Board issues its decision in the case.

After the suspension period has expired, Punktum dk will delete the notified Domain Name unless the notifier has prior to this requested Punktum dk to have the Domain Name transferred.

9.2 Punktum dk may suspend a Domain Name if:

  • The Domain Name is used in connection with an obvious risk of economic crime, the compromising of IT equipment, for example phishing and malware distribution, and/or content of a highly offensive nature, and
  • The use of the Domain Name creates a risk of confusion with the Domain Name, name, logo, trademark, or other distinctive marks of another natural or legal person, and
  • the circumstances call for not awaiting a decision from the Danish Complaints Board for Domain Names (Klagenævnet for Domænenavne) or the courts.

The suspension of the Domain Name is maintained for four weeks or, if the decision on suspension is appealed to the Danish Complaints Board for Domain Names (Klagenævnet for Domænenavne) until the Board issues its decision in the case.

After the suspension period has expired, Punktum dk will delete the Domain Name, unless the Registrant has documented to Punktum dk that the circumstance that motivated the suspension no longer exists.

9.3 Punktum dk may suspend a Domain Name if:

  • The Domain Name is used in connection with manifestly illegal acts or omissions that infringe substantial considerations of security or public interest, and
  • the circumstances call for not awaiting a decision from the Danish Complaints Board for Domain Names (Klagenævnet for Domænenavne) or the courts.

The suspension of the Domain Name is maintained for four weeks or, if the decision on suspension is appealed to the Danish Complaints Board for Domain Names (Klagenævnet for Domænenavne) until the Board issues its decision in the case.

After the suspension period has expired, Punktum dk will delete the Domain Name.

9.4 Punktum dk may suspend a Domain Name if:

  • The Domain Name is used in connection with manifestly illegal acts or omissions, and
  • an injunction or prohibition in a specific case regarding illegal content on a website has first been sought against the infringer or other intermediaries than Punktum dk, who technically contribute to the spread of the illegal content, and
  • such an injunction or prohibition – in view of the purpose hereof – is not a real possibility or must be considered hopeless or has proven insufficient, and
  • the circumstances call for not awaiting a decision from the Danish Complaints Board for Domain Names (Klagenævnet for Domænenavne) or the courts.

The suspension of the Domain Name is maintained for four weeks or, if the decision on suspension is appealed to the Danish Complaints Board for Domain Names (Klagenævnet for Domænenavne) until the Board issues its decision in the case.

After the suspension period has expired, Punktum dk will delete the Domain Name.

9.5 Punktum dk may suspend a Domain Name based on a specific notification of the Domain Name in question, including an administrative decision, made by a ‘trusted flagger’ approved by Punktum dk.

The suspension of the Domain Name is maintained for four weeks or, if the decision on suspension is appealed to the Danish Complaints Board for Domain Names (Klagenævnet for Domænenavne) until the Board issues its decision in the case.

After the suspension period has expired, Punktum dk will delete the Domain Name.

9.6 If the manifestly illegal act or omission is directly related to a specific Domain Name, Punktum dk may block the Domain Name and thereby prevent any new registration of the Domain Name.

Blocking a Domain Name means that Punktum dk ensures that the right of use of the Domain Name can no longer be obtained, and that the Domain Name cannot be registered in Punktum dk’s systems and name servers cannot be connected.

10. Enforcement of decisions

10.1 Punktum dk will transfer, delete or block a Domain Name if there is a decision to that effect from a court or an arbitration tribunal, if the Danish Complaints Board for Domain Names (Klagenævnet for Domænenavne) has made a decision to that effect, or if a competent authority has issued a valid injunction to that effect.

Decisions shall be enforced in the manner specified by Punktum dk.

10.2 A Domain Name subject to a court order for seizure will be transferred to the police, who will then become the Registrant of the Domain Name.

11. Complaint and case administration requirements

11.1 Punktum dk shall make decisions under these Terms and Conditions as quickly as possible.

When notifying a Registrant of a decision that is not in their favor, Punktum dk provides guidance on their right to appeal to the Danish Complaints Board for Domain Names (Klagenævnet for Domænenavne).
 

12. Changes to Terms and Conditions

12.1 Punktum dk may unilaterally amend these Terms and Conditions, and Registrants are thus subject to the Terms and Conditions in force at any given time. Punktum dk may change its prices in accordance with Clauses 5.8 and 12.3 of these Terms and Conditions. Punktum dk may make other amendments to the Terms and Conditions, including amendments resulting from changes in the administration of .dk domain names, products, services, decisions by courts or authorities, legislation or market developments.

Punktum dk publishes minor amendments to the Terms and Conditions no later than one month before the amendment enters into force.

Registrants of a Domain Name will be individually informed of major amendments to these Terms and Conditions no later than one month before the amendments enter into force. Registrants may terminate the Agreement before the amendments enter into force. If the Registrant does not terminate the agreement, the Registrant is deemed to have accepted the changes.

12.2 The price of services under the Terms and Conditions is adjusted annually and without notice on 1 April in line with the annual increase in the index. The index adjustment is

based on the net price index published by Statistics Denmark for October of the previous year. The price is adjusted by the percentage increase in the net price index, rounded up to the nearest whole 25 øre.
If the publication of the net price index ceases, Punktum dk may continue to make index adjustments on the basis of another index published by Statistics Denmark.

12.3 These Terms and Conditions are available in Danish and English. In the event of any discrepancies between the two versions, the Danish version shall prevail.

13. Limitation of liability

13.1 Punktum dk cannot be held liable for any loss that a decision to suspend, block, delete or transfer a Domain Name may involve, and Punktum dk cannot be held liable for any indirect loss suffered by a Registrant.

13.2 Punktum dk cannot be held liable for a Registrant’s infringement of third-party rights.

13.3 The Registrant is obliged to indemnify Punktum dk in connection with any disputes regarding the right of use of a Domain Name.

13.4 Punktum dk is not liable for any loss that a Registrant may incur as a result of the enforcement of decisions under Section 10.

13.5 Punktum dk’s liability in all cases shall be limited to a maximum of DKK 100,000 per suspension, blocking, deletion, or transfer of a Domain Name.

13.6 The liability limitations in Clauses 13.1–13.5 do not apply in the event Punktum dk has acted intentionally or with gross negligence.
 

14. Governing law and venue

14.1 Any dispute between Punktum dk and a Registrant shall be settled in accordance with Danish law. The venue is Copenhagen City Court.
