Obvious risk of confusion, phishing, malware etc.

You must contact Punktum dk if you wish to complain about a domain name due to obvious risk of confusion. If you succeed in your complaint, we can suspend the domain name.

Conditions

In order for Punktum dk to be able to use the rule on obvious risk of confusion to suspend a .dk domain name, three conditions must be met.

  1. The Domain Name is used in connection with an obvious risk of economic crime, compromising of IT equipment, for example phishing and malware distribution, and/or content of a highly offensive nature, and
  2. The use of the Domain Name creates a risk of confusion with the Domain Name, name, logo, trademark or other distinctive marks of another natural or legal person,
  3. The circumstances call for not awaiting a decision from the Complaints Board for Domain Names or the courts.

It is important to note that all conditions must be met before we can suspend the domain name. If all conditions are not met, Punktum dk does not have the authority to make use of this rule to suspend the domain name. Consequently, this suspension rule cannot be applied based on risk of confusion alone.

What do we take into account when we make our decision?

Our assessment is based on the documentation you submit and on our own investigation of the complaint.

The risk of confusion may relate to the actual domain name or to the content of the website with the .dk domain name in question.

When we assess the circumstances, we also decide whether, due to the nature of the circumstances, it is not possible to wait for the ruling from the Danish Complaints Board for Domain Names or the courts.
