You should inform Punktum dk before the court hearing. This gives Punktum dk the opportunity to appear at the court hearing or submit a declaration of waiver that they do not wish to appear at the court hearing.

Punktum dk can also provide guidance on what information must appear in the warrant in order for a seizure to be effectuated.

In order for Punktum dk to implement a seizure of the domain name, it is necessary that the order also contains the following information:

  • A correct indication of the domain name to be seized,
  • A correct indication of the registrant's name and address,
  • Information that the seizure is taking place at Punktum dk A/S, which is not a suspect in the case and
  • Indication of what Punktum dk must do, i.e. how the seizure of the domain name must take place. For example, "[xxxx.dk] must be seized if the domain name is transferred to [the police unit] as a new registrant of Punktum dk A/S, who is not a suspect".

You can send the ruling via the contact form on Punktum dk's website. You can find the contact form here or via Punktum dk's website, use the category "Seizure/court order".

Remember that together with the order you must submit a number of other information:

You must state if the domain name is to be transferred to an existing user ID and the e-mail address to be used for the transfer itself.

The process at Punktum dk will be faster if you also state whether the web hosting company is outside Denmark.

If the domain name is not to be transferred to an existing user ID, you must state which police unit is to have the domain name transferred as well as the VAT number, P-number, telephone number, email address and possible contact person.

Prior to the handover, your unit will be asked to complete an ID control with MitID check.

You can easily register a domain name by following these three steps:

  1. Check to see if the domain name is available in our whois database.
  2. Register the domain name through one of our approved domain name providers. You can see a list of .dk domain name providers.
  3. Activate the domain name by entering into the agreement with us concerning the right to use a domain name in our online self-service portal.

The domain name is now ready to use.

Punktum dk initiates the transfer of the domain name to the police by sending an email with a link to our self-service to the police. The police unit must log in, enter into an agreement on the right to use the domain name and pay a fee for the transfer. The police become the registrant of the domain name with all associated rights and obligations.

If it is close to the expiry date of the period for which a fee has already been paid, a fee will also be charged for the next year's registration period.

When the seized domain name has been handed over to the police, Punktum dk informs the former registrant that the domain name has been seized and by what police unit. Punktum dk also sends the decision on seizure of the domain name with the information to the former registrant.

When your unit has become a registrant, you can change name servers on the domain name and let the domain name point to the police's own website. This could be a website with a banner showing that the domain name has been seized.

If the police do not change the name server, the old website with the illegal content may continue to be displayed.

Also, your unit has become the registrant of the domain name and is covered by the terms of the right of use for the domain name, including payment of the annual fee for the right of use. If the fee is not paid, the domain name will be suspended and then deleted.

The police must ensure that the seizure is lifted when it is no longer relevant.

In the event of a seizure, the Danish police obtain the right to dispose of the seized domain name. Therefore, the police can carry out a confiscation by keeping the right to use the domain name and possibly terminating the agreement on the right to use the domain name. If the right of use is terminated, the domain name can be registered again by anyone and everyone, including the person who had it seized. Confiscation is thus carried out without the active help of Punktum dk.

Punktum dk would like to be notified if a domain name is subsequently confiscated.

It costs DKK 72.50 per year including VAT to have a .dk domain name.

This fee covers the costs of Punktum dk in connection with maintaining a database of all Danish domain names and upholding the Danish part of the internet’s infrastructure (DNS).
